Please read these terms carefully before using our services, purchasing any plan or downloading any digital product.

By using our services, you agree to these terms

These Terms and Conditions constitute a legally binding agreement between you and Nutrition by Namita. By booking a consultation, purchasing a plan, downloading a digital product or browsing this website, you confirm that you have read, understood and agreed to all terms stated on this page. If you do not agree, please do not use our services.

Acceptance of Terms

These Terms and Conditions govern your use of the website nutritionbynamita.com and all services provided by Nutrition by Namita, operated by Namita, a certified nutritionist based in Bhopal, Madhya Pradesh, India.

These terms apply to all visitors, clients, and users of the website and services, including those who purchase consultation plans, digital products or free resources. These terms are subject to change and the most current version will always be available at this URL. Continued use of the services after any changes constitutes acceptance of the revised terms.

If you are booking on behalf of another person such as a family member, you represent that you have the authority to accept these terms on their behalf.

Medical Disclaimer

Nutrition by Namita provides nutritional education and dietary guidance only. Namita is a certified nutritionist, not a medical doctor, physician, psychiatrist or licensed medical professional.

The information, meal plans, blog articles, PDFs and consultation advice provided through this website and service do not constitute medical advice, diagnosis or treatment. Nothing communicated during a consultation or through any content on this website should be interpreted as a substitute for professional medical advice from a qualified doctor.

If you have a medical condition, are taking prescription medication or are under the care of a healthcare provider, you must consult your doctor before making any changes to your diet based on advice received from Nutrition by Namita. We strongly recommend informing your treating physician about any nutritional guidance you receive from us.

Client Health Disclosure and Non-Disclosure Liability

Nutritional guidance is highly personalised and is designed specifically around the health information you provide. Your safety and the effectiveness of your plan depend entirely on the accuracy and completeness of the information you share during your health assessment and throughout your consultation.

Your Responsibility to Disclose

Before or during your first consultation, you are required to truthfully and completely disclose all of the following:

  • All current and past medical conditions including but not limited to diabetes, thyroid disorders, kidney disease, liver disease, cardiovascular conditions, eating disorders, hormonal disorders, autoimmune conditions and cancer
  • All prescription medications, over-the-counter drugs, supplements and herbal remedies you are currently taking or have taken in the past 6 months
  • All known food allergies, food intolerances and sensitivities including but not limited to nuts, dairy, gluten, shellfish, eggs, soy, seeds and spices
  • All known drug allergies or adverse reactions to any substances including medications, supplements or foods
  • Any history of eating disorders, disordered eating behaviours or history of extreme dieting
  • Pregnancy, breastfeeding, or plans to become pregnant
  • Recent surgeries, medical procedures or hospitalisations
  • Any other condition, medication or allergy that you reasonably believe could affect your response to dietary recommendations

Full Liability Disclaimer for Non-Disclosure: Nutrition by Namita and Namita personally will bear absolutely no responsibility, legal liability or financial obligation for any adverse health outcome, medical consequence, allergic reaction, drug-nutrient interaction, worsening of a medical condition, hospitalisation or any other harm arising directly or indirectly from your failure to disclose any prior disease, medical condition, food allergy, drug allergy or medication at the time of consultation. By using our services, you acknowledge and accept this condition without reservation.

If your health circumstances change at any point during your consultation plan, including new diagnoses, new medications or newly discovered allergies, it is your responsibility to inform Namita immediately before continuing with the plan. Failure to communicate such changes releases Nutrition by Namita from any and all liability for any consequences arising from that non-disclosure. Nutrition by Namita expressly reserves all rights and remedies available under applicable law in connection with any such non-disclosure by the client.

Nutrition by Namita cannot and does not verify the accuracy of health information provided by clients. All meal plans and recommendations are prepared in good faith based solely on the information you provide. If the information you provide is incomplete or inaccurate, your plan may not be safe or appropriate for you. This risk rests entirely with you.

Services Provided

Nutrition by Namita offers the following services through its website and consultation platform:

  • One-to-one personalised nutrition consultation via video call or phone
  • Personalised Indian meal plans based on client health assessment
  • Ongoing WhatsApp support for active consultation plan clients
  • Digital products including downloadable PDF meal plans and nutrition guides
  • Educational blog content on nutrition, PCOD, insulin resistance, diabetes and weight management

Namita reserves the right to decline service to any individual at her sole discretion, including where the client's medical condition requires supervision beyond the scope of nutritional guidance, or where a client's behaviour is disrespectful or abusive.

All services are provided online. Nutrition by Namita does not offer in-person consultations at this time. Consultations are conducted via video call (Google Meet, Zoom or WhatsApp Video) at the agreed time.

Payment Terms

All payments for consultation plans and digital products are processed securely through Razorpay, a fully PCI-DSS (Payment Card Industry Data Security Standard) compliant payment gateway. Razorpay is certified under PCI DSS Level 1, the highest level of compliance in the payments industry. Nutrition by Namita does not store, process or have access to your card details or sensitive payment information at any point. All payment data is handled exclusively within Razorpay's certified secure infrastructure.

Payment Options

The following payment arrangements are available:

  • One Time and 1 Month Plans: Full payment at the time of booking via Razorpay
  • 3 Month Plan: Full payment upfront, or a 2-instalment split (50% to book, 50% before Session 3) on request
  • 6 Month Plan: Full payment upfront, or a 3-instalment split (40% at booking, 30% in the 2nd month, 30% in the 4th month) on request
  • 1 Year Plan: Full payment upfront, or a 4-instalment split (30% at booking, then 3 equal quarterly instalments) on request. If any quarterly instalment is not received on the due date, the plan will be automatically paused until payment is made.

To request an instalment arrangement, simply mention it when booking via WhatsApp or email [email protected] before payment. Sessions for the next period will only commence once the corresponding instalment is received on time.

Instalment clients enjoy the same full plan benefits as upfront payers. There is no extra charge or fee for choosing an instalment arrangement. We simply ask that instalments are paid on the agreed dates so your plan continues without interruption.

Accepted Payment Methods

  • UPI (Google Pay, PhonePe, Paytm, BHIM) — preferred and fastest
  • Credit cards and debit cards (Visa, Mastercard, RuPay)
  • Net banking
  • Razorpay payment links (shared on WhatsApp or email on request)

Late or Missed Instalment Payments

If an instalment payment is not received within 3 days of the agreed due date, the upcoming session may be paused until payment is made. We will send a friendly reminder before this happens. Repeated missed instalments may result in the plan being converted to a shorter completed plan with no further sessions.

Pricing and Taxes

All prices are in Indian Rupees (INR) and inclusive of applicable taxes. Nutrition by Namita reserves the right to revise pricing at any time. Price changes will not affect plans already booked and paid.

Failed Payments

If your payment fails but an amount has been deducted, it will be automatically reversed by Razorpay within 5 to 7 business days. Contact [email protected] if the reversal does not occur within this period.

Nutrition by Namita is not responsible for any bank charges, currency conversion fees or transaction fees applied by your bank or card issuer.

Refund Policy

Consultation Plans

A full refund will be issued only if the cancellation request is made at least 24 hours before the commencement of your first consultation session. Once the first session has commenced, no refund will be issued under any circumstance, regardless of the number of sessions remaining in the plan.

No refund will be issued if the cancellation request is made less than 24 hours before the first session, after the first session has taken place, due to dissatisfaction with results, due to missed sessions, or for any reason once the consultation has commenced.

Digital Products

All digital products including PDF meal plans and guides are non-refundable once downloaded or accessed. Exceptions apply only in cases of non-delivery due to a technical error or duplicate charge. Report such issues within 48 hours of purchase to [email protected].

Refund Processing

Approved refunds are processed within 5 to 7 business days to the original payment method. To request a refund, email [email protected] with your full name, transaction ID and reason.

Intellectual Property Rights

All content created and provided by Nutrition by Namita is the exclusive intellectual property of Namita and Nutrition by Namita. This includes but is not limited to:

  • All personalised meal plans, nutrition plans and dietary recommendations created for you
  • All PDF digital products including meal plan guides and e-books
  • All blog articles, written content, guides and educational material published on nutritionbynamita.com
  • All graphics, design elements, logos and visual identity of the Nutrition by Namita brand
  • All video consultation recordings where applicable
  • All WhatsApp messages, voice notes and written communication containing nutritional advice

You may not copy, reproduce, redistribute, resell, publish, share, upload, screenshot or otherwise use any content, meal plan or PDF provided by Nutrition by Namita for any commercial purpose or for sharing with third parties without the express written permission of Namita. Meal plans and PDFs are licensed for your personal use only.

Personal Use License

Upon purchase of a consultation plan or digital product, you are granted a limited, non-exclusive, non-transferable, non-sublicensable personal use license to use the provided content solely for your own personal health and nutrition purposes. This license is granted to you alone and cannot be assigned or transferred to any other individual. It does not permit you to share, teach, publish, sublicense or profit from any content provided by Nutrition by Namita in any manner whatsoever.

Violation of Intellectual Property

Nutrition by Namita reserves the right to pursue legal action under the Copyright Act, 1957 (India) and applicable intellectual property laws against any individual or organisation found to have infringed upon our intellectual property rights. This includes sharing PDFs in WhatsApp groups, posting meal plans on social media or any other form of unauthorised distribution.

Confidentiality and Privacy

Nutrition by Namita treats all client health information with strict confidentiality. Your personal details, health history, medical conditions, blood reports and consultation notes will never be shared with any third party without your explicit written consent, except where required by law.

Clients are similarly expected to maintain the confidentiality of any proprietary methods, meal planning frameworks or nutritional strategies shared during consultations. These may not be disclosed to competitors or used to set up competing nutritional services.

All communication through this website is processed in accordance with applicable Indian data protection principles. We store only the minimum information necessary to provide our services and do not sell your data to any third party.

Client Conduct

Nutrition by Namita is committed to maintaining a professional, respectful and supportive environment. All clients are expected to:

  • Communicate respectfully and professionally with Namita and any team members at all times
  • Attend scheduled sessions on time or provide at least 12 hours advance notice for rescheduling
  • Provide honest and accurate health information during assessment and throughout the consultation period
  • Not share, record or distribute any consultation session content without prior written permission
  • Not use this service for any purpose that is unlawful, harmful or deceptive
  • Not attempt to replicate or commercialise any content, meal plan or method shared during consultations

Namita reserves the right to immediately terminate service to any client who engages in abusive, threatening, harassing or disrespectful behaviour without any refund obligation.

Termination of Services

Termination by Client

You may terminate your consultation plan at any time by notifying Namita in writing via email to [email protected]. Refund eligibility upon termination is strictly governed by the Refund Policy in Section 6. Once the first consultation session has commenced, termination of the plan under any circumstance does not entitle you to a refund of any amount paid.

Termination by Nutrition by Namita

Nutrition by Namita reserves the right to terminate or suspend your consultation plan immediately and without prior notice in the following circumstances:

  • You have provided false, misleading or incomplete health information that poses a risk to your safety
  • Your medical condition has progressed beyond the scope of nutritional guidance and requires immediate medical intervention
  • You have engaged in abusive, threatening or disrespectful conduct toward Namita or any team member
  • You have violated the intellectual property terms by sharing, reproducing or commercialising any content provided
  • Continuing the service might, in Namita's professional judgement, cause harm to you or others

In the event of termination by Nutrition by Namita for reasons beyond client misconduct, the matter will be reviewed and any resolution communicated directly via email. No refund will be issued where termination is due to client misconduct or violation of these terms.

Limitation of Liability

To the fullest extent permitted by applicable law, Nutrition by Namita and Namita shall not be liable for any direct, indirect, incidental, consequential, special or punitive damages arising from or related to your use of our services or website, including but not limited to:

  • Any adverse health outcomes, medical complications or allergic reactions resulting from non-disclosure of medical history, allergies or medications
  • Any failure to achieve expected health or weight loss results
  • Any interruption, delay or discontinuation of services due to technical issues, illness or circumstances beyond our control
  • Any third-party content, links or resources referenced on or accessible through this website
  • Any unauthorised access to or breach of your personal data through means outside of our reasonable control
  • Any loss of data, files or personal information stored on your own devices

Our total aggregate liability to you under these terms shall not exceed the total amount you paid for the specific service that gave rise to the claim. This limitation applies regardless of the form of action, whether in contract, tort, negligence or any other legal theory, and even if Nutrition by Namita has been advised of the possibility of such damages.

Governing Law and Jurisdiction

These Terms and Conditions shall be exclusively governed by, and interpreted in accordance with, the applicable laws of the Republic of India, without regard to its conflict of law principles. Specifically, the following legislation applies where relevant:

  • Indian Contract Act, 1872 — governs the formation and enforcement of this agreement
  • Consumer Protection Act, 2019 — governs consumer rights and dispute resolution
  • Information Technology Act, 2000 — governs electronic transactions and digital communications
  • Copyright Act, 1957 — governs intellectual property rights over all content and materials
  • Personal Data Protection principles — governs the handling of your personal and health data

Dispute Resolution

In the event of any dispute, claim or controversy arising from or related to these terms or our services, both parties agree to first attempt resolution through direct communication. Please email [email protected] with the details of your concern. We commit to responding within 5 business days.

If the dispute cannot be resolved through direct communication within 30 days, it shall be subject to the exclusive jurisdiction of the courts located in Bhopal, Madhya Pradesh, India. Both parties consent to submit to the personal jurisdiction of such courts.

For consumer grievances, you also have the right to approach the appropriate Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019, in the jurisdiction of your place of residence.

Changes to These Terms

Nutrition by Namita reserves the right to update, modify or replace these Terms and Conditions at any time without prior notice. All changes will be effective immediately upon posting on this page with an updated date shown at the top.

It is your responsibility to review these terms periodically. Continued use of our services after any changes constitutes your acceptance of the revised terms. If you do not agree to the revised terms, you must discontinue use of our services immediately.

For active consultation clients, material changes to terms that affect ongoing plans will be communicated by email to the address provided at booking.
